Billing Policy
This Agreement shall always be effective and applicable for the use of the Site or any of the Services and shall continue to apply even after the termination of your use of the Site or the Services to any prior viewing, use of the Site and /or Services. Unless otherwise specified, any Services provided to you are provided on an automatically renewing basis. Your purchase will extend for the period initially specified by you and will automatically renew thereafter for additional periods equal in length to the period initially specified, unless terminated in terms of this Agreement.
Where the commencement of a Service is delayed, the renewal date of the Service will be calculated from the date the Service commenced.
Automatic Renewal
If the Service Order does not specify a time period, the Service will automatically renew monthly, unless terminated by you by giving Hosted. com 1 (one) calendar months’ notice of termination in writing. Termination of any Service will not be effective until acknowledged in writing by Hosted.com.
You will be emailed an invoice for the renewal term at the email address in your account in advance of any renewal with the terms of the upcoming Renewal Term, including duration and price of such renewal.
Hosted.com will automatically renew the Services in terms of this Agreement and will take payment from the Payment Method you have on record. Hosted.com shall not be liable to you or any other party for any costs, loss, or damage of any kind if it is unable to charge your Payment Method in order to renew any Services.
Domain Renewals
Domain names are set to AUTOMATICALLY RENEW seven (7) days before the expiration date to ensure no disruptions of services occur.
Responsibility for Payment
You agree to pay all fees and charges due for Services purchased or obtained from the Site as stated at the time you order the Domain and/or Service(s). Fees and charges are non-refundable unless otherwise expressly stated in writing, regardless of whether the Services are suspended, terminated, or transferred prior to the end of the term of the Service. Hosted.com may change or modify its fees and charges at any time without prior notice. These changes will be posted on the Site and will be effective immediately upon posting. If you have purchased or obtained Services for a specified period, changes or modifications in fees and charges shall be effective when the Services in question come up for renewal.
Failure to Renew
Accounts that have invoices which are more than fourteen (14) days overdue will be suspended. If a suspended account is to be reactivated, all of the overdue invoices will need to be paid to make it
current before the suspension is lifted. Accounts that have invoices more than two months overdue are considered abandoned and will be subject to termination.
Refunds
All third-party fees, including domain registration and renewal fees, setup fees and migration fees, are non-refundable, non-negotiable, and excluded from our Money Back Guarantee. Further, SSL Certificates have a seven (7) day refund window from time of purchase.
Accounts that are terminated due to Terms of Service violations are not eligible for a refund or any service credits. Domain registrations and renewals, setup fees and migration fees are not refundable. Service credits have no cash value and are extended at our discretion.
All refunds are subject to the terms of service for any third-party payment processor and those terms take precedence over the terms in our Policies. In the event we are unable to refund any fees or charges via the method of payment, we will use commercially reasonable efforts to return or credit the appropriate funds to you.
If you paid us by credit card, we would credit the credit card on file. If you paid us through another payment processor, we would take steps to refund the appropriate fees through that payment processor. If the information we have on file for your account is not up to date, your refund may not be completed thus taking additional time to refund. If we are unable to return the funds, as described above, within three months of the date when the refund is due and owing then said funds shall escheat to Hosted.com.
Hosted.com is not responsible or liable for fees deducted from any refund processed.
Payment Method and Currency
All fees, charges and transactions are processed in United States Dollars (US$). Hosted.com will not be liable for any exchange rate fluctuations or conversion fees or charges by your bank.
Hosted.com is not responsible for domains being lost or taken by a third party during the transition period between the registration and the receipt and clearing of the payment for said domains. Domain name registrations are only deemed to be registered when confirmation of registration is supplied to Hosted.com by the Registry and not when payment is received.
Payment is made by you through credit card (“Payment Method”) via Stripe or any other payment gateway used by Hosted.com. Hosted.com reserves the right to add other payment gateways at any time and these will be reflected in the payment process.
Chargebacks
If you discover an error on your invoice, please notify us as soon as possible by utilizing one of the approved communication methods (EG; support ticketing system) by submitting a ticket to our Billing Department. We will honour invoice errors as long as we are notified of them within Fourteen (14) days. If more than Fourteen (14) days has elapsed, we reserve the right to decline the refund request. If a refund is in order it will go onto your account as a service credit to be used on a future invoice. Service credits have no cash value.
Any received chargebacks will incur a forty-dollar ($40) investigation fee on the associated billing account and all services will be immediately suspended pending investigation. Hosted.com may reject the future use of payment methods from an account for which a chargeback has been previously issued. Upon receipt of a chargeback or payment reversal, the account related to the payment may be suspended or terminated.
General
Should any amount be outstanding by more than 60 Business Days, Hosted.com may refer the matter to a debt collection agency or attorney for collection. Should it do so, you will be liable for all administration fees which may be published on the Site from time to time, as well as any legal costs and attorneys’ fees arising from collection of the outstanding amount.
Hosted.com may increase or decrease its fees for any Service from time to time.
If you have been given a discount or any type of incentive as a result of referring a third party to Hosted.com, the discount will be forfeited if the referee terminates its agreement with Hosted.com within three (3) months of commencement. Discounts must be in writing and signed by an authorized agent of Hosted.com.
