Copyright Infringement

Hosted.com®’s products, Services, websites, applications and/or tools permit customers to host and make content available over the Internet. Although Hosted.com® does not affirmatively screen any customer content, and does not tolerate infringing material on its equipment, it may, in its sole discretion and without any legal obligation to do so remove the content, and/or limit access to the content that may infringe upon the rights of a third party. 

Before Hosted.com® can take any action regarding a claim, the Digital Millennium Copyright Act (“DMCA”) requires that a proper notice of claimed infringement be submitted, which must contain all of the following information: 

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed (i.e., merging a scanned handwritten signature into the electronic text or using public-key encryption technology).
2. A detailed description of the alleged infringing material, or, if multiple copyrighted works are alleged to be infringing material, a representative list of such works on this website.
3. A detailed description of where the alleged infringing material is located on this website.
4. Information sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that perjury is deliberately giving false testimony; the act or crime of knowingly making a false statement (about a material matter) while under oath or bound by an affirmation or other officially prescribed declaration that what one says, writes, or claims is true. 

Each complaining party must submit a separate claim for each claim of infringement. 

Please provide all of the requested information, signed under penalty of perjury. 

Hosted.com® cannot and will not act on this matter until all of the requested information is provided. 

Please be advised that any complaint submitted may be forwarded to third parties, including the customer related to the complaint, for purposes of validating its contents. 

A complainant may provide the above required information via email to legal@hosted.com

Upon receipt of a valid and complete notice, Hosted.com® will notify the alleged infringer requesting the removal of the alleged infringing material of which failure to do so may result in the temporary, partial or full access restriction to the material and or website. 

If the alleged infringer removes the content, no further action will be taken by Hosted.com® and the matter will be considered closed.
